Non-Attendance, Late Attendance, Cancellations and Refunds

If you do not attend a pre-paid booked class or cancel a booking with less than 24 hours’ notice you will still be charged for the class. If you hold a class pass, late cancellations and no shows will be charged to the pass.

When booking for workshops or special events, please note that we can only provide a full refund (less an admin fee or non-refundable deposit) for cancellations made more than 30 days before the start date. After this, we will refund 50% of the cost of the training (less an admin fee or non- refundable deposit) up until a cut off point of two weeks prior to the event.

Refunds will not be offered on workshops if cancellations are made within two weeks of the training commencing.

If a course or workshop is cancelled by the teacher, you will be offered either a full refund or the option of attending an alternative event and your payment transferred to the new date. This is the only instance that there can be a transfers between workshops or classes.

If a workshop, class or training is being offered by an external promoter, please make sure you understand their cancellation policies as they may differ from ours.

Teacher Training Cancellation and Refund Policy

When applying for teacher training please note that we can only provide a full refund (less your non-refundable deposit) for cancellations made more than 8 weeks before the training start date. Refunds will not be offered if cancellations are made after the 8 week cut off.

Please note that there can be no transfers between courses and fees are non-transferable to another training, except in exceptional circumstances. If the course is cancelled by the teacher, you will be offered either a full refund or the option of attending an alternative event.

Privacy & Security Policy and Commitment to Data Security

Your personal information is kept secure. Only authorised employees, and workshop hosts, where applicable (who have agreed to keep information secure and confidential), have access to this information. All emails and newsletters from our sites allow you to opt out of further mailings if you would want to cease receiving information.

Enrolment to Workshops, Teacher Training and Classes Waiver

1. Liability Waiver (automatic on enrolment): Please understand by attendance:

I shall indemnify and hold harmless, Claire Missingham, its agents and employees from all liability, losses, costs, claims, damages, and expenses, including lawyer’s fees, arising or claimed to have risen out of personal injuries, death, property damage or loss, sustained by me as a result of participating in one or more of these programmes (Online and Face-to-Face Courses, Classes, Workshops, Retreats), however caused, including, without limitation, claimed negligence on the part of Claire Missingham employees, other participants, or third parties. In addition, I shall indemnify Claire Missingham, agents and employees from all liability, losses, costs, claims, damages, and expenses, including lawyer’s fees, relating to claims, injury, or death arising from my own negligence or intentional acts during my participation in this program (including travel to and from the activity sites) and I hereby release and forever discharge Claire Missingham, and its agents and employees from all such liability, loss, cost, claims, damages, or expenses.

2. Travel Contingencies

I understand that the program leaders, the director, and the assigned staff members are acting in their respective capacities as agents of Claire Missingham, and hereby waive any and all claims I may have or purport to have against Claire Missingham against them individually for losses occasioned by any changes in travel plans, or for the failure of any of the companies providing transportation, hotel, food, tour services, or other goods or services, as applies to the nature of this program, to provide such services on a timely basis or for the failure to provide them at all.

3. Force Majeure

Claire Missingham shall not be in breach of its obligations under this agreement or incur any liability to the other for any losses or damages of any nature whatsoever incurred or suffered as a result of Force Majeure. Force Majeure includes acts unforeseeable circumstances such as, but not limited to; fires, explosions, earthquakes, drought, tidal waves and floods; wars or hostilities (whether declared or not) invasions, acts of foreign enemies, mobilisation, requisition, or embargo; acts of threat of Terrorism; Political unrest, rebellion, insurrection, or military or usurped power, or civil war, riot, commotion, strikes, go-slows, lockouts or disorder, contamination by radioactivity from any nuclear fuel, or from any nuclear waste from the combustion of nuclear fuel, radio-active toxic explosive, or other hazardous properties of any explosive nuclear assembly or nuclear component of such assembly.

4. Right to Agenda

Claire Missingham has the right to make cancellations, changes, or substitutions in courses, the agenda, or program, assigned staff members, travel arrangements, or arrangements for other services, in the event of causes beyond its reasonable control, significantly changed conditions or changes in the interests of the group.

5. Statement of Wellbeing

I am physically healthy, and psychologically and emotionally stable. I understand that Claire Missingham, and any or all of its employees or representatives, are not medical or psychological professionals, and that the programmes (Online and Face-to-Face Courses, Classes, Workshops, Retreats), and the practices therein are not a substitute for seeking professional help for any medical, psychological, physical, or emotional issues that may pre-exist or arise throughout my participation in this course.

6. Medical Release

I understand that I am participating in Yoga, Meditation, and other physical activities and waive, release and forever discharge Claire Missingham, its agents employees from all such liability, loss, injury, death, cost, claims, damages, or expenses that may occur before, during, or after participation in any and all activities before, after or through the course of the programs. In the event of illness or injury, I hereby authorise the program director or an assigned staff member to obtain emergency or other medical treatment as he or she deems necessary, including the administration of anaesthetics or other medications and surgery, and I hereby assume both any physical risk associated with and responsibility for the cost of such treatment.

7. Insurance and Medical Expenses

I understand it is my responsibility to obtain and keep in force adequate health insurance while traveling and I understand and agree I am financially responsible for my own medical expenses.

8. Personal Property

I am solely responsible for obtaining and keeping safe my personal possessions, documents, money, travel tickets (as needed), and other property. I hereby waive and release Claire Missingham, the program director, and the assigned staff members from any and all claims for expenses or losses of any nature and amount due to my failure to do so.

9. Confidentiality and Non-Disclosure

I certify that all information from Online and Face-to-Face Courses, Classes, Workshops, Retreats is held in strictest confidence. This includes personal information, stories, or experiences shared in confidence by other participants in sessions or in private conversation with other participants. I understand that my login to website portals are mine and mine alone. I will not share it with other people regardless of their registration status. I understand that this confidentiality does not extend

to information shared verbally, in writing, or demonstrated by instances of my behaviour with staffor representatives of Claire Missingham that may lead them to believe that I am a danger to myself or others. I understand that any action taken therein is in the best interest of protecting me, my fellow participants, the staff of Claire Missingham and the integrity of programming and services. I understand that any action therein is based on the sole discretion of managing staff of Claire Missingham from any and all liability, losses, costs, claims, damages, and expenses, including lawyer’s fees, arising or claimed to have risen out of any such decision. I understand that this confidentiality and nondisclosure extends to staff, operations, programming, and inner workings of Claire Missingham and all programming therein.

10. Media Release

I understand that Claire Missingham, its representatives, and affiliates are filming and / or taking photographs in classes, workshops or events for Claire Missingham and / or additional artistic / promotional use. If you do not wish to be seen on camera, please place yourself outside the defined edge of frame floor markers - and identify yourself to the Staff who will make sure that your privacy and in-class experience is respected.

11. Conditions of Service

I understand that if the proper steps and procedures are not followed, and if the deposit and tuition are not paid, then I will not be able to enrol or participate in the programmes: Online and Face-to-Face Courses, Classes, Workshops, Retreats. I understand that my access to the programme may be terminated if payment is not made.
